A Bridgetown magistrate today dumped a $250 fine on a 38-year-old vendor who said that he liked to smoke a spliff while on the toilet.
And Dave Orlando Straker, of St Mary’s Row, St Michael only has three weeks to pay that money to the District ‘A’ Magistrate’s Court if he wants to avoid spending the same period of time at HMP Dodds.
Police were conducting investigations in Straker’s area when he was stopped and questioned. According to the prosecutor when a search of his person was requested he began to sweat profusely and the illegal substance was found.
“That is mine, I was going to the toilet and smoke,” the accused told the police at the time.
Before Magistrate Douglas Frederick this afternoon Straker explained that he goes home to smoke because he was told that he could not smoke on the road.
“When I got to my apartment I walk into a detective and he asked me if I is Dave Straker and I tell him yes.”
The accused went on to say that the police then questioned him about items belonging to a neighbour, which he said he knew nothing about.
He said the search was requested but he instead pulled out the drug from his pocket and showed it to the police because “it’s a habit that I got that when I on the toilet I does pull a spliff.”
