Teen accused remanded

An 18-year-old accused of having sex with a 13-year-old girl has been remanded to Her Majesty’s Prison, Dodds, St Philip and will return to court next month.

He is Tristan Nathaniel Leacock, of Flint Hall, Welches, St Michael, who appeared before acting Magistrate Anika Jackson in the District ‘A Magistrates’ Court.

 He was not required to plead to the indictable charge of having sex between November 1 and 30, last year with the teen.

 Prosecutor, PC Kenmore Phillips in asking the court not to grant bail, noted the nature and seriousness of the offence. Defence counsel Lennox Miller however spoke of Leacock’s previously clean record, adding that he was not a danger to anyone.

Haynes warned to stay away from store

At 59, Karen Ann Haynes admitted to a court that she is a recovering drug addict and is looking for a job.

She made the confession when she appeared before Magistrate Graveney Bannister in the Traffic Court and pleaded guilty to stealing powder and eyeliner worth $16 from No. 1 Beauty Supplies, on January 26, 2019.

 Haynes, of Garden Land, Country Road, St Michael, also admitted that marijuana was her drug of choice, adding “I don’t have a drug problem anymore. I have been off for about a year.”

 In reprimanding and discharging her, Magistrate Bannister warned: “Stay away from No 1 Beauty Supplies. Do not venture there. Go and find honest work.”

A Bridgetown magistrate has issued her second warning in a week, that using marijuana is still illegal in Barbados, despite the fact that discussion was ongoing about medicinal marijuana,

Acting Magistrate Anika Jackson presiding in the District ‘A’ Magistrates’ Court made the remarks after two accused Roxanne Rosette Gill a 31-year-old hairdresser of Newton Crescent, Pine, St Michael and 57-year-old self-employed Anthony Hyvestra Blenman of Maxwell Coast Road, Christ Church were jointly charged with unlawfully having cannabis worth $10 on January 28. They both pleaded guilty.

When the matter was called, they appeared without counsel but the court was informed that attorney-at-law Mohia Ma’at was on his way to represent the duo.

According to the facts outlined by Prosecutor, PC Kenmore Phillips, police officers went to Newton Crescent, Pine, St Michael and saw a parked car with Blenman in the front passenger seat with the door open and Gill standing by the open door. When lawmen  approached the vehicle Gill removed a white cigarette from her mouth, put her hand in her pocket and then passed a white piece of paper to Blenman and started to walk away.

When asked to open the folded paper, police saw one greaseproof wrapping, one paper wrapping and a partially burnt cigarette with vegetable matter, suspected to be cannabis, and Blenman said “I tell she police coming to give me the spliff.”

The defence counsel submitted that the two were not charged together, adding that police came back for Gill about an hour after they had taken Blenmanaway.

In begging for leniency, Ma’at said that Gill is a mother of two and lived with her family including parents and siblings, and Blenman is a senior and his prior offences dated back to the 1980s.

The two apologised to the court.

The acting magistrate said that they were adults and ought to have known better. She fined them $375 each, payable in three months or on default, three months in jail.

Holder remanded on wounding charge

A Christ Church businessman charged in connection with the incident that left another man with severe injuries to his hand, has been remanded to Her Majesty's Prisons at Dodds, St Philip for 28 days and will return to court on February 26.

Corie O'Neil Holder, 39, of 179 Regency Park, Christ Church, appeared in the District 'A' Magistrates’ Court before Acting Magistrate Anika Jackson and was not allowed to plead to the indictable charge of unlawfully and maliciously wounding Alban Mottley of Newbury, St George, on January 15, 2019, with intent to maim, disfigure or disable him. The incident is alleged to have taken place at Station Hill, St Michael.

Prosecutor, PC Kenmore Phillips had asked the court not to grant bail because of the seriousness of the offence and the complainant was at the hospital awaiting surgery.

His counsel, attorney-at-law, Kendrid Sargeant had described him as a fit candidate, but the acting magistrate remanded the businessman because of the medical report and after checking his antecedents.

Drug accused granted bail

Ken DaCosta Murrell pleaded guilty to two drug charges but not guilty to two charges involving a policeman. As a result, he was granted bail in the sum of $750 and the matter has been adjourned until February 12 to the Traffic Court.

Murrell, 37, of Second Avenue Park Road, Bush Hall, St Michael, appeared before acting Magistrate Anika Jackson in the District ‘A’ Magistrates’ Court on four charges.  He pleaded guilty to the unlawful possession of cocaine and having apparatus fit and intended for use in connection with cocaine, but not guilty of resisting PC Jason Chambers and unlawfully and maliciously wounding the same policeman.  The incidents allegedly occurred on January 28, 2019.

The unemployed man is represented by attorney-at-law, Naomi Linton.

Back to prison

Only last December 10, Andrew Sylvester Moore walked out of Her Majesty’s Prison, Dodds, St Philip, after completing a prison sentence. However he returned there yesterday having been remanded after pleading not guilty to theft.

The charge against Moore, 44, of no fixed place of abode, is that on January, 29, 2019, he stole a pair of sunglasses belonging to Anderson Wood.

In objecting to bail, Prosecutor, PC Kenmore Phillips noted that if granted bail, Moore would re-offend, adding that he ended a prison term last December.

Acting Magistrate Anika Jackson noted that his conviction card started in 1992 and the most recent offence was in January last year.

He pointed to his head suggesting that he had a mental problem, but the acting magistrate said she had seen his theatrics on entering the court and told him he would get assistance at the prison.

Taylor back to court in June

A 27-year-old self-employed woman of Westbury Road, St Michael, must return to court on June 4, after pleading not guilty to four charges including using abusive language to a policeman.

The charges against Shanice Rickeena Taylor are - that on January 29, 2019, she unlawfully used threatening words to PC Paul Goddard; unlawfully used abusive language to the same officer and unlawfully assaulted him. The final charge was obstructing PC David King.

The matter came up before Acting Magistrate Anika Jackson in the District ‘A’ Magistrates’ Court and she granted bail in the sum of $750 with one surety. She further ordered that Taylor report to Central Police Station twice weekly before 9 a.m.

Complainant has change of heart

Too many people involved in domestic disputes get hot-headed and call the police and later come to court and say they are not going through with the case.

Acting Magistrate Anika Jackson made this remark after another complainant appeared in the District ‘A’ Magistrates’ Court and asked that a matter be discontinued.

She reiterated that it was costing the taxpayers since it involved police having to go through the entire process and it was also a waste of the court’s time, adding that such persons be asked to pay costs as was done previously.

She acceded to the request of Richelle Walker, who said she was not coerced into discontinuing the matter, adding that she and the young man involved Nicholas Henry Rico Bailey, were co-parenting their six-year-old daughter.

Among the charges which dated back to November 2016 was that the accused used a cell phone to send a threatening communication to the complainant.

Bailey however still has other matters pending, and must return to court on May 23.

Teenager charged!

An 18-year-old male has been charged with the unnatural deaths of three people – two women and a man.

Ramario Antonio Roach, of River Bay, St Lucy is accused of murdering his mother, Joann Roach, 38, of the same address, whose partially decomposed body was discovered in a watercourse in the same area on Monday, January 21.

The teen is further charged with the murder of Dr Sarah Sutrina, 68, of No. 124 Wanstead Gardens, St James whose mutilated body was discovered on Tuesday, January 22, at Ocean Estate Northumberland, St Lucy.

It is also alleged that Roach murdered Tyrone Austin, 68, of Free Hill, Black Rock, St Michael. Austin’s lifeless body was discovered in a bushy area at Wanstead Gardens, St James on December 18, 2018.

The accused appeared in the Holetown Magistrates’ Court today before Magistrate Wanda Blair and was remanded until February 28.

Before that he will appear in the District ‘A’ Magistrates’ court on February 6 in connection with Austin's death.

Hefty fine for red light

Not stopping at a traffic light has cost a driver $1000.

That was the fine handed down by Magistrate Graveney Bannister in the Traffic Court to Kenmore Clarke of Dash Road, Bank Hall, St Michael, who pleaded guilty to the offence of May 20, 2018.

Clarke said he was going through the amber light, when the lights changed.

The magistrate noted that such offences were too prevalent. Failing to pay the forthwith fine, Clarke will spend 100 days in prison.

Bail denied

A 39-year-old St John auto repairman has been remanded to Her Majesty’s Prison, Dodds, St Philip, after appearing in the District ‘A’ Magistrates’ Court on several charges.

Acting Magistrate Anika Jackson, in handing down the order on Nicholas Andre Harewood of Glebe Land, St John, has remanded him for 28  days and he will return to court on March 1.

However, for other charges he will appear in the District ‘C’ on February 5.

 He was not allowed to plead to the indictable matters which are:

on December 12, 2018, without lawful excuse, he damaged by fire a house belonging to Kirk White of Church Gap, Jackson, St Michael;

on the same day, without lawful excuse, he damaged one vehicle, the property of Kirk White;

also on that day, he stole one cellular phone valued $600, belonging to Abigail Campbell of Church Gap, Jackson, St Michael;

between August 14 and 15, 2018, he stole one car battery valued $214.56; one bumper, valued $200; one socket light valued $70; two headlamps valued $150 all totalling $636.56 belonging to Tyrone Walters of Mayers Road, My Lord’s Hill, St Michael;

between August 14 and 15, 2018, he stole a grille valued $75, two headlamps valued $294, two indicator lights valued $20, one transmission cooler valued $550, one battery valued $290.80, one bumper valued $200, two  bumper re-enforcers valued $94, one water bottle valued $50, two side motion lights valued $80, six light sockets valued $1.50, one TRD emblem valued $50, one light set valued $322, one battery terminal valued $45, total value $2,062;

between August 10 and 11, 2018, he stole one bonnet valued $600;

on December 31, 2018, he stole $2 587 in money, two bags valued $68, six bottles valued $12, two packs of cigarettes valued $30, 15 cigarettes valued $15, ten packs of wrappers valued $30, two packs of mints valued $22, two packs of biscuits valued $20, and 43 cigarette lighters valued $43 belonging to Elvis Beckles of Hothersal Land, St John.

It is further alleged that he assaulted as well as unlawfully and maliciously wounded Beckles on the same day.

Prosecutor Police Constable Kenmore Phillips in objecting to bail, told the court that Harewood was on bail when the alleged offences were committed.

His defence counsel is attorney-at-law Vonda Pile whose application for bail was denied.

Accused changes his guilty plea

Earlier in the week when Aaron Jairaj Brisport appeared on a wounding charge before Acting Magistrate Anika Jackson, he pleaded guilty and the facts were outlined by prosecutor Police Constable Kenmore Phillips.

However when he showed some misunderstanding, the matter was adjourned. Today, when the matter resumed, he had as defence counsel, Michael Lashley, QC, in association with Dayna Taylor-Lavine. Lashley made a submission to have the earlier plea vacated and it was granted.

Brisport, 20, of Salters, St George, is accused of unlawfully and maliciously wounding Curwen Bishop of St Stephen’s Landing Scheme, Black Rock, St Michael, on January 27.

The acting magistrate read the charges and Brisport pleaded not guilty.

Before granting bail in the sum of $750, the acting magistrate warned Brisport and Bishop “to see each other and don’t interfere . . . if any issues arise we have facilities in place. Don’t take the law into your own hands.”

The matter was adjourned until July 3.

Fenty facing two assault charges

Rorrey Ronald Fenty, 29, of Westland Heights, St George, pleaded not guilty to two charges and was granted bail in the sum of $1,000 and will return to court on June 6.

The charges are that on January 20, he unlawfully assaulted Lee-Ann Lingo while on the MV Dream Chaser and that on the same day, assaulted Andrew Thornton, occasioning him actual bodily harm.

The matter was in the District ‘A’ Magistrates’ Court before Acting Magistrate Anika Jackson.

Millar fined for drugs

Antonio Ryan Millar must pay $750 in a month or spend two months in jail, after pleading guilty for having $30 worth in drugs.

This sentence was handed down by Acting Magistrate Anika Jackson in the District ‘A’ Magistrates’ Court.

Millar, 23, of Third Avenue Nurse Land, Tweedside Road, St Michael, was charged with unlawfully having cannabis on January 21, 2019.

According to the facts outlined by prosecutor Police Constable Kenmore Phillips, police were on patrol on Tweedside Road, St Michael, when they saw Millar riding without a helmet. When they stopped him, they became suspicious after they observed him rubbing his pants pockets. He was searched and a bag containing four greaseproof wrappings with vegetable matter suspected to be cannabis was found.

In a plea of mitigation, attorney-at-law, Akelia Reid who appeared for Millar, urged the acting magistrate to impose a fine noting that the self-employed youth had a pregnant girlfriend and furthermore, he was co-operative with the police.

Remain honest

On her first day back on the Bench after holiday, a Bridgetown magistrate reminded young attorneys not to “mix your clients’ money with yours”.

Welcoming the staff and attorneys-at-law this morning Magistrate Kristie Cuffy-Sargeant of the District ‘A’ Magistrates’ Court sounded the reminder, warning, “You’ve spent five years studying hard, take back the profession where it ought to be,” she added.

Her comments came following reports of the recent disbarment of an attorney-at-law.

Among the cases coming before her today was one involving a first-time offender who uses marijuana daily, but who said he’s going to try to stop.

Laron Rudolph Junior Marshall, of 15J Crest View Terrace, Eden Lodge, St Michael, told Magistrate Cuffy-Sargeant in the District ‘A’ Magistrates’ Court where he  pleaded guilty to unlawfully having five grams of cannabis on February 2, 2019.

Marshall apologised to the court and his family and he was ordered to complete 80 hours of community service and was grant bail in the sum of $1 500.  He will return to court on April 5, 2019.

Accused owns up to his part in domestic dispute

A retiree will return to court today to hand in his passport after pleading guilty to assault.

Thelma Lee Warren Jr., 69, of 21A Apartment 6, Joyce Mason Avenue, Jackson, St Michael, appeared in the District 'A' Magistrates' Court before Magistrate Kristie Cuffy-Sargeant, charged with assaulting Stencha Augustin of No. 78, Crystal Heights, St James on February 2, 2019.

According to Prosecutor, S/Sgt. Cameron Gibbons, the two were in a relationship for two years and she usually visited his home.

On the day of the incident, Augustin, who also smoked marijuana and used cocaine, visited Warren's home and he accused her of stealing US$700 from him.

The prosecutor said that as a result, the two were involved in a dispute and Warren struck her in the face and placed a rope around her neck and beat her about the body. Eventually Augustin freed herself and reported the matter to the police.

The medical record was unavailable and the magistrate adjourned the hearing until February 13, 2019.

“Party” smoker must pay

A Christ Church youth was fined $1 000 in two months for unlawfully having 0.7 grammes of cannabis on February 3, 2019.

He is Jeremy Anson Jones, of Brewster Road, Worthing View, Christ Church, who pleaded guilty to the offence in the District ‘A’ Magistrates’ Court before Magistrate Kristie Cuffy-Sargeant.

In apologising to the court, the mechanic said “I was in possession of marijuana. I did not want to be here,” adding that he only smoked at parties.

He returns to court on April 4, 2019.

Riley remanded

A 33-year-old father who attempted to remove a minor without permission last weekend has been remanded after appearing in a Bridgetown Magistrates’ Court.

Oneil Ricardo Riley of Kensington New Road, St Michael pleaded not guilty to four charges before Magistrate Douglas Frederick and will return to court on March 5, 2019.

He is charged with assaulting a woman on January 31, 2019 and on August 19, 2017 and with unlawfully removing a ten-year-old girl without her consent or the consent of a legally authorised person on February 2, 2019. He is further charged with recklessly engaging in conduct which placed the ten-year-old in danger of death or some serious bodily harm on the same date.

Prosecutor Sergeant Carrison Henry, in objecting to bail, noted the seriousness of the matter, and pointed out that two of the offences were allegedly committed on a minor and if granted bail, the minor would be put in danger. Furthermore, he noted that Riley was currently on bail for another matter and had an unpaid fine of $2,000.

In response, attorney-at-law Rasheed Belgrave, who appeared for Riley, submitted that his client was a fit candidate for bail.

Feuding family

It all started with the playing of loud music. but ended with four cousins in court and were reprimanded and discharged for causing a disturbance on February 4, 2019.

In making the order on Lina Thomas, 28, and Shavon Larrier-Welch, 22 of Brewster’s Road, Barbarees Hill, St Michael; Shaneka Shajan Welch-Cherry, 21, of Fifth Avenue Skeete’s Road, The Ivy, St Michael and Anthony Victor Aurelius, 19, also of Brewster’s Road, Magistrate Douglas Frederick told them, “As a family, I expect you to behave better. Don’t let this happen again. Go in peace.”

The family told the District ‘A’ Magistrates’ Court that there was a misunderstanding and they were sorry.

Thomas said that one family member wanted to listen to the news while the other was listening to music. When asked to tone it down, he refused which led to a dispute and a disturbance and the police were called.

Popular thief put on bond

“Get help! You need something to stop you from doing this. Go to a church and get some assistance. They won’t refuse you!”

That’s what a Bridgetown magistrate advised a 55-year-old woman who once again pleaded guilty to stealing from Popular Supermarket.

Magistrate Douglas Frederick noted that Maylene Narrie Corbin had appeared before him earlier for a similar offence at the same store, and said “I am sorry, I will not do it again.”

In addition to living alone, Corbin said she had been divorced since 1995, had no children and depended solely on the $72 from the Welfare Department. She has also had two toes amputated.

The charge against Corbin was that on February 4, 2019, she stole three roll-ons, valued $7.05; three packs of Turbo Drink Mix valued $7.92 and one O’Henry chocolate, valued $1.99 and all belonging to BJ’s Value Mart, trading as Popular Discounts.

According to Prosecutor, Sergeant Carrison Henry, the elderly woman went to the Spry Street branch of the supermarket with a red bag. She took a basket from the store and went through the various aisles and placed the items in her basket. She was observed by security and when she attempted to leave was stopped and searched and the items found.

Magistrate Frederick placed her on a bond for six months and if breached, she will spend three months in prison.
