A pervert who used his phone to record a tourist as she used the toilet will spend Christmas and the New Year at HMP Dodds.
When he appeared in the District ‘A’ Magistrates’ Court today, Kerry Wendell Mason, 38, of Bayfield, St Philip, pleaded guilty to loitering on the premises of Lobster Alive on December 4, 2018, where there was cause to suspect he was about to commit an offence in malicious communication.
Referring to his actions as “out of character” Mason apologized profusely to Magistrate Kristie Cuffy-Sargeant.
The musician and first-time offender said he did not know what got into him.
“I was working as a pianist and I was on break so I went to use the bathroom. I was talking on my phone via Whatsapp and I heard a door slam like someone had entered the bathroom,” he explained.
“As a result I held up my hand and started to film it. It was only for about three seconds and then I took down my hand, but she had already noticed.
“I am very sorry. I apologized to the lady at the scene. It is something that I have never done. It was impulsive and immoral and not within my character,” Mason added.
The magistrate however remanded him to prison until January 2.
The court heard from prosecutor Sergeant Cameron Gibbons that a British visitor went to Lobster Alive to have dinner with a friend. During the night she went to use the bathroom and while there, she observed a hand through the window holding a cellphone taking pictures while she was using the toilet.
The complainant quickly got dressed, screamed and ran out of the bathroom.
Staff members came to her assistance and intercepted Mason and held him until police arrived on the scene.
