Legall denied bail despite lawyer’s plea

A bail application by the attorney of Iscah Mordecai Legall of No. 148 Husbands Gardens, St James could not get him out of jail.

A magistrate today denied his bail and ordered that he remains on remand at Dodds prison.

The 34-year-old is accused of causing serious bodily harm to Tammy Davis on April 25 with intent to maim, disfigure or disable her, as well as possession of cannabis on April 26.

Legall has been in custody since his first appearance before Magistrate Kristie Cuffy-Sargeant.

When his case was called today his new attorney Safiya Moore made an application for Legall to be granted bail pending trial.

After the prosecutor again objected Moore argued that the accused man and the complainant lived a “considerable distance” from each other and that conditions could be imposed to ensure his attendance at court and noninterference with the complainant.

She further argued that Legall had been on remand for over a month, and although he was the accused he too had rights.

However, Cuffy-Sargeant stated that she kept hearing about the rights of the accused, but not about the alleged victim.

“There must be a balance when we are asking for justice. It can’t be justice for the accused only. I sit here everyday and hear about the rights of the accused, what about the rights of the complainant? [They] must be protect as well,” the judicial officer said as she denied the bail application.

The accused man will return to the District ‘A’ Magistrates’ Court on July 20.
