He had been coming to court for the past six years after being accused of committing a robbery.
But Jadai Junior Clarke will not have to return to court to deal with that matter.
When he reappeared in the District ‘A’ Magistrates’ Court yesterday, Clarke had the six-year-old robbery charge thrown out.
The decision to dismiss the case was made by Magistrate Kristie Cuffy-Sargeant after the prosecution was unable to present a file.
The then 17-year-old, of School Lane, Halls Road, St Michael, had denied robbing Patrick King of a cell phone valued $780 and $90 in cash on April 8, 2012.
However, no progress had been made by the prosecution, and after several attempts to have the case dismissed, Clarke’s attorney, Queen’s Counsel Andrew Pilgrim, was finally successful.
He had argued that six years was more than enough time for the prosecution to be in a position to deal with the matter.
But after charging his client with the offence, Pilgrim lamented that a file was still yet to be produced.
On the previous occasion, the magistrate had signaled to the prosecution that there would be a final adjournment.
However, when Clarke reappeared in court, the prosecution still was not in a position to begin, leaving Cuffy-Sargeant with little choice but to dismiss the matter.
